Guardianships in California to Care for Children

In California, a guardianship is when a judge gives a person who is not the child’s parent custody over the child or the authority to manage the child’s financial affairs, or both.

The two common circumstances when a legal guardianship might be used are:

  • Both the child’s parents die, and the parents designated a guardian as part of their estate planning documents
  • The parents are living but unable to care for the child, so a court designates another person to have custody and control over the child

Conservatorships in California to Care for the Elderly

If a person becomes incapacitated – that is, unable to care for him or herself physically or financially – what can family members or close friends do to help? If the individual has not designated powers of attorney for heath care and finances, then you may want to consider a conservatorship.

A conservatorship is a legal proceeding in which the court grants a person control over an adult’s physical well-being or financial affairs, or both. The first kind of conservatorship is known as a conservatorship of the person. The second kind of conservatorship is known as a conservatorship of the estate. The person who is the subject of the conservatorship is known as the conservatee.

The conservatee retains many rights during a conservatorship relationship. For example, the conservatee may still make or change a will, have a lawyer and control his or her own salary.
